1. Eligibility

You must be legally capable of entering into a binding agreement to make purchases or create an account through HBCU GameTrip.

If you use HBCU GameTrip on behalf of an organization, you represent that you have authority to bind that organization.

2. User Accounts

Certain features may require an account.

You are responsible for:

• Providing accurate information
• Maintaining the confidentiality of login credentials
• Activities conducted through your account
• Promptly notifying us of suspected unauthorized access

We may suspend or terminate accounts involved in fraud, abuse, prohibited conduct, chargeback misuse, or violations of these Terms.

3. HBCU GameTrip Platform

HBCU GameTrip provides access to HBCU events, tickets, travel resources, destination information, cultural experiences, and related services.

Depending on the transaction, the event itself may be produced, operated, or controlled by an HBCU, conference, promoter, venue, or other third party.

HBCU GameTrip may provide technology, ticketing, marketing, discovery, payment, and related services without being the producer or operator of every event listed on the platform.

4. Tickets and Event Purchases

Ticket availability is subject to change.

Before completing a purchase, you are responsible for reviewing:

• Event
• Date
• Time
• Venue
• Ticket quantity
• Seat location, where applicable
• Price
• Service fees
• Taxes
• Applicable refund terms

A transaction is not complete until payment has been successfully processed and confirmation has been issued.

Tickets may be delivered digitally, through a downloadable file, mobile wallet, account portal, or another method identified during purchase.

5. Prices, Fees, and Taxes

Ticket prices may be established by the event organizer.

HBCU GameTrip may charge service, platform, processing, fulfillment, or other disclosed fees.

Applicable fees and taxes will be presented during checkout before purchase is completed.

Unless otherwise required by law, fees may be non-refundable where disclosed at purchase.

6. Refunds, Postponements, and Cancellations

Refund policies may vary by event and event organizer.

The refund or cancellation terms applicable to a ticket will be the terms presented for that event or purchase.

If an event is:

• Cancelled
• Postponed
• Rescheduled
• Relocated

the event organizer may establish the applicable refund, credit, exchange, or ticket-validity policy.

HBCU GameTrip may assist with processing an authorized refund but does not independently control event cancellations or scheduling decisions made by event organizers.

7. Travel Services

Hotel, flight, transportation, and other travel services displayed through HBCU GameTrip may be supplied or fulfilled by independent third-party providers.

When you complete a booking through a third-party provider:

• The provider’s terms apply
• The provider controls availability
• Cancellation and refund rules may differ
• Prices may change until booking is confirmed
• HBCU GameTrip does not control airline, hotel, or transportation operations

You should review the applicable provider’s terms before completing a reservation.

8. Destination and Place Information

HBCU GameTrip may provide information regarding:

• Restaurants
• Nightlife
• Attractions
• Cultural institutions
• Neighborhood businesses
• Parking
• Transit
• Transportation
• Hotels
• Other destination services

Information may come from HBCU GameTrip, community sources, partners, Google Maps Platform, or other third-party providers.

Business hours, prices, availability, addresses, ratings, menus, transportation options, and other details may change.

You should verify time-sensitive information directly with the relevant provider before relying on it.

9. Google Maps Features and Content

HBCU GameTrip includes features and content provided through Google Maps Platform.

By using Google Maps features and content through HBCU GameTrip, you acknowledge that your use is subject to the then-current:

Google Places applications are required to notify users of these applicable Google terms.

Google Maps information may include third-party content, and HBCU GameTrip does not guarantee the accuracy or continued availability of that content.

10. Reviews and User Content

If HBCU GameTrip allows you to submit reviews, photographs, comments, recommendations, or other content, you remain responsible for that content.

You may not submit content that is:

• False or intentionally misleading
• Defamatory
• Threatening
• Harassing
• Discriminatory
• Obscene
• Fraudulent
• Infringing
• Unlawful
• Commercial spam

By submitting content to HBCU GameTrip, you grant HBCU GameTrip a non-exclusive, worldwide, royalty-free license to host, display, reproduce, format, distribute, and use that content in connection with operating and promoting the platform.

11. Culture Tags and Editorial Designations

HBCU GameTrip may identify places or experiences using editorial classifications such as:

• Black-Owned
• HBCU-Owned
• HBCU Alumni-Owned
• Historic Black Business
• HBCU Connection
• Cultural Landmark
• Other cultural or community designations

These classifications are intended to assist discovery.

Ownership, affiliation, cultural identity, or organizational status can change. HBCU GameTrip does not guarantee that every designation remains current indefinitely.

Businesses or users may contact HBCU GameTrip to request review or correction of a designation.

12. Sponsored and Partner Content

Certain events, destinations, offers, experiences, or content may be supported by:

• HBCUs
• Conferences
• Destination organizations
• Sponsors
• Corporate partners
• Promoters
• Travel partners

Where appropriate, sponsored or promotional relationships may be identified.

Sponsorship does not alter a user’s obligation to independently evaluate purchases, travel decisions, or third-party services.

13. Prohibited Uses

You may not:

• Use HBCU GameTrip for unlawful purposes
• Access accounts without authorization
• Attempt to bypass ticketing controls
• Circumvent ticket limits
• Use automated systems to purchase tickets unfairly
• Scrape or systematically extract platform content without permission
• Disrupt platform security
• Introduce malicious code
• Commit payment fraud
• Misrepresent your identity
• Reproduce or commercially exploit HBCU GameTrip content without authorization

14. Intellectual Property

HBCU GameTrip, Ticketality, associated software, branding, graphics, designs, text, organization, and original content are protected by intellectual-property laws.

School names, trademarks, logos, conference marks, venue marks, Google content, and third-party materials remain the property of their respective owners.

Use of third-party marks on HBCU GameTrip does not necessarily imply ownership or endorsement unless expressly stated.

15. Availability of the Service

We may:

• Modify features
• Add or remove services
• Perform maintenance
• Suspend portions of the platform
• Change integrations
• Update functionality

We do not guarantee uninterrupted or error-free availability.

16. Disclaimer of Warranties

To the fullest extent permitted by law, HBCU GameTrip is provided on an “as available” and “as is” basis.

We do not guarantee:

• Event availability
• Travel availability
• Third-party services
• Accuracy of all third-party content
• Continuous platform availability
• Particular travel or event outcomes

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, HBCU GameTrip and Flavor Is Art, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the platform.

This includes losses associated with:

• Cancelled events
• Travel disruptions
• Third-party services
• Lost profits
• Lost opportunities
• Business interruption
• Unauthorized account use
• Reliance on third-party destination information

Nothing in this section limits liability where limitation is prohibited by law.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless HBCU GameTrip, Flavor Is Art, LLC, and their officers, employees, contractors, and affiliates from claims arising from:

• Your violation of these Terms
• Your unlawful use of the platform
• Content you submit
• Your violation of another party’s rights

19. Termination

We may restrict or terminate access to HBCU GameTrip when reasonably necessary to:

• Protect the platform
• Protect users
• Prevent fraud
• Enforce these Terms
• Comply with law

Sections intended by their nature to survive termination will remain in effect.

20. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Any dispute not otherwise resolved between the parties will be handled in the appropriate state or federal courts located in Fulton County, Georgia, unless applicable law requires otherwise.

21. Changes to These Terms

We may update these Terms periodically.

The current version will be posted on HBCU GameTrip with the applicable Effective Date.

Continued use of the platform after an update constitutes acceptance where permitted by law.
